Acceptable Use and Indemnification Policy

RockIP, LLC (RockIP) reserves the right to change this policy, without notification, at any time. Compliance with RockIPs policies is solely the responsibility of the customer.

The purpose of this policy is to protect you, other customers, and RockIP against any harm. It is not the intent of this, or any other RockIP policy, to infringe upon any freedoms including the freedom of speech. However, RockIP is also striving to improve customer service, family values, and a safe internet environment for people of all ages. Therefore, the following policy has been set forth as a means to provide that. If you have any questions or comments about this, or any other, policy or service, please feel welcome to contact us.

CONTENT POLICY

All services provided by RockIP may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization. The subscriber agrees to indemnify and hold harmless RockIP from any claims resulting from the use of the service which damages the subscriber or any other party.

Pornography and sex-related links or merchandising is prohibited on all RockIP servers. This includes sites that may infer sexual content, or links to adult content elsewhere. RockIP will be the sole arbiter in determining violations of this provision.

Also prohibited are sites that promote any illegal activity or present content that may be damaging to RockIP servers or any other server on the internet. Links to such materials are also prohibited. Examples of unacceptable content or links:

  • Pirated software
  • Hacker programs or archives
  • Warez sites (defined as: ???????????)
  • Pornography or Adult Material

RockIP will be the sole arbiter as to what constitutes a violation of this provision. RockIP does not host competitor sites or web pages promoting sites of its competitors.

Any deliberate attempt to cause damage to RockIP or any other Internet servers will result in immediate account deactivation without prior notice. No refund is given in this case.

ACCOUNT OWNERSHIP

RockIP is not responsible for controlling the content, access to the content, or ownership of the content other than to the immediate/present owner of the account containing said content. RockIP verifies ownership by credit card number, name, address, email address, username, and password. RockIP is not responsible for any information or content that is on your account, that is deleted from your account, that is changed from your account, or is used illegally through your account should any access to that account be given to any person except the immediate/present account holder/owner. RockIP warns that if the account holder gives their information to any other party or gives access to the account holders email address on their account to another party, that account holder risks having their website and any other information or content on their account changed, deleted, or stolen by that other party.

If you are acting as the account holders web designer and you are not the account holder, RockIP advises you receive payment for any work you may perform prior to publishing that work to our servers. Once any information, website, image, or other content are published to our servers, the account holder then retains ownership of that content.

SPAM

RockIP is committed to a zero-tolerance, anti-spamming policy. That is, we prohibit Spam, or any violation of United States law related to Spam, from being sent either: over RockIPs network, by customers or users of the RockIP network including any and all customers of the account holder, or over any network (if the message sent advertises, mentions, or alludes to a site hosted by RockIP. RockIP also prohibits the selling of products that are used for spamming.

RockIP reserves the right to investigate the claim of spamming, to terminate the services, without prior notice, of any account holder who disregards this policy.

EMAIL POLICY

RockIP may not be the source, intermediary, or destination address involved in the transmission of any unsolicited email, email bombs, hate email, or any mass email. Your email account may not be referenced as originator, intermediary, or reply-to address of such email. RockIP considers mass email as any email messages sent to more than 10,000 email addresses in one day or more than 10 news groups.

Email accounts should be kept below 10 MB in total. If your email account becomes greater than 10 MB, RockIP reserves the right to move the email to another server and delete it after 30 days. The owner of the email account will be contacted before we move the mail. If your mail has been moved please contact RockIP Tech Support via support@rockip.com email to correct the situation before the emails are deleted. It is solely the responsibility of the owner of the email account to contact RockIP in a timely manner in order to keep any wanted emails from being deleted.

RockIP accepts no responsibility for viruses that may be transmitted to you or any other user via email, ftp, http or any other means of electronic transfer. RockIP does provide some virus scanning on its servers. However, not all viruses can be detected, and not all viruses are scanned for different operating systems. Therefore, we cannot prevent the transmission of viruses to your computer system via the Internet. It is the responsibility of the client to ensure they have Virus Software and that it is updated and used regularly.

CHAT POLICY

RockIP does not allow chat rooms. You can however link your site to a chat provider.

CGI SCRIPTS POLICY

Each account comes with its own CGI-bin. You are free to use any CGI scripts you wish, however RockIP reserves the right to disable any CGI script that effect normal server operation or service to other RockIP customers. For the protection of all of our customers, RockIP also reserves the right to terminate the account of those customers who continue to run scripts that effect normal server operation. No chat rooms or similar scripts are allowed

SUB HOSTING POLICY

RockIP will allow the hosting of multiple websites depending on the type of shared hosting plan the account holder has purchased. To find out which plan best fits your needs, check out our ? page.

Additional sites share the transfer, disk space, email, and mySQL allotments granted in the initial plan. Only 1 control panel is provided. Subdomains (of the form "subdomain.domain.com") are considered additional sites and deduct from the available site total in the same manner as completely separate domains.

TRAFFIC POLICY

RockIP recommends to its customers to refrain from storing any files that can or may cause excessive traffic on our servers. Please contact RockIP Technical Support to answer any question on this policy.

RockIP reserves the right to charge additional fees to any account holder who exceeds our traffic limits. Notification will be given in the event that you exceed our traffic limits. Once that notification is given, the account holder must either eliminate the excessive traffic, or purchase an additional package to cover any additional traffic. Failure to act within 48 hours of notification will result in the suspension of the account. Continued disregard for this policy is grounds for account termination without notice.

BACKUPS

Full backups are made weekly, and backups of new/changed data made nightly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the clients' responsibility to maintain local copies of their web content and any information on their account including but not limited to clients website, email, databases, mailing lists, and archives. The "Archive Manager" is included in each hosting plan and client can use this tool to back up their files. If loss of data occurs due to an error of RockIP, we will attempt to recover the data at no charge to the client. If data loss occurs due to negligence of client in securing their account or by an action of the client, RockIP may attempt to recover the data from the most recent archive for a $50.00 fee.

INDEMNIFICATION POLICY

RockIP reserves the right to refuse service or to terminate service to anyone for any reason not prohibited by law. The account holder or any user agrees to use all RockIP services at their own risk. RockIP specifically disclaims all warranties of merchantability and fitness for a particular purpose. In no event shall RockIP be liable for any loss, loss of data, or other commercial damage, including but not limited to special, incidental, consequential or other damages. The customer agrees that it shall defend, indemnify, save and hold RockIP harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorneys fees asserted against RockIP, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by the customer, its agents, employees or assigners.

The customer agrees to defend, indemnify and hold harmless RockIP against liabilities arising out of:

  • any mental, physical, or psychological injury to person or property caused by any products sold or otherwise distributed in connection with RockIPs server;
  • any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;
  • copyright infringement and
  • any defective products sold to customer from RockIPs server.

RockIP shall be the sole judge of what violates this Policy.

Obscene for us in this policy is considered any material that is not accepted by typical, reasonable people as not be decent. This includes: images depicting penetration or any sexual act between any group of people, animals, objects or the like; any image deemed illicit by the United States government, or any image of genitalia that is not directly being used for educational purposes and is of a legal nature according to the United States government. Obscene does not include images of an artistic or educational nature that do not directly violate the aforementioned.

If account is not paid by credit card and the account holder does not wish to pay or to be verified by credit card, then and only then will RockIP verify the owner by????????? Account holders email address must be through an account that also verifies the account holders identity.
